About the service
These draft terms describe Dearly Space, operated by Johnson Crystal Kalu in Nigeria. Questions can be sent to contact@dearlyspace.com. The owner's legal capacity, business address and final effective date must be confirmed before publication.
The app helps you keep personal memories on your device. The website manages accounts and paid plans. It does not provide an online memory viewer or automatic real-time synchronisation between phones. You must have legal capacity or appropriate guardian authorisation to use account and paid services.
Accounts and responsible use
Free offline use does not require signing in. Accounts are required for Premium and cloud backup. Provide accurate account information, keep sign-in details private and verify your email for cloud uploads. You are responsible for content you store, upload or share and for having the necessary permissions regarding other people, recordings and copyrighted material.
Do not use the service unlawfully, infringe another person's rights, distribute malicious files, attempt unauthorised access or interfere with operation. We may restrict access where reasonably necessary for security, unlawful use or a legal obligation. We will provide notice where practical and lawful.
Plans and yearly billing
Free currently includes up to 5 profiles and the features described on the plans page. Premium currently costs NGN 1,500 yearly, with 100 MB cloud backup storage and the purchased profile allowance. There is no monthly plan. The price and applicable conditions shown at checkout control a new purchase.
When supported and enabled, Premium renews automatically each year after your express renewal consent. Paystack or Stripe handles hosted checkout. A success screen alone does not activate Premium; server payment verification is required. Do not start another payment while an earlier payment is being confirmed.
You can stop renewal through Billing. Cancellation preserves paid-through access unless a refund, charge reversal or another lawful reason changes it. An account-deletion request stops renewal as part of cleanup and ends access to the deleted account. Provider failures can delay confirmation; contact support for help. Deletion or cancellation does not itself promise an automatic refund. Refund requests and statutory rights will be handled under applicable law; the owner must approve the final refund procedure before paid launch.
Future changes to prices or renewal terms will be communicated before they apply where required. Purchased allowances are recorded with the subscription; adding a future plan does not silently rewrite an existing purchase.
Backup, restore and your copies
Cloud backup is optional. Up to two completed copies are retained within the total storage allowance, which also counts pending uploads and deletions. A new copy must fit alongside existing copies; an upload that cannot fit does not replace your old copy. You may need to remove an old copy or reduce archive size.
Automatic backup is opt-in, Wi-Fi-only by default and scheduled by the operating system. Closed-app backup may be delayed or prevented by connectivity, battery settings, force-stop or expired sign-in. No exact time is promised. Check the last successful backup and keep an independent export when something is important.
Restore merges memories into the device and keeps unrelated existing memories; matching records can take the newer edit, including deletions. Save a separate export first. After Premium expiry, cloud restore is available for 30 days, then cleanup removes the cloud copies. Expiry does not erase local memories. App-side archive encryption is deferred; the initial release does not provide end-to-end encryption.
Ownership, sharing and privacy
You retain your rights in your content. You allow us and our service providers to store, process and transmit it only as needed to provide requested features, maintain security and meet legal obligations. Shared or exported files are under your control and may remain with recipients. Read the Privacy Policy for information about accounts, providers and data choices.
Deleting an account
Use Delete account in website Account settings. Confirm your current password and the warning. Pending payments must be resolved first. Accepted requests remove account identity and sign-ins, cancel renewal and erase cloud backups, with retries for temporary provider failures. Minimal payment references remain where necessary for accounting and legal obligations.
This does not remotely erase phone memories or external files. App logout clears its local library after confirmation. Keep an export before deleting: erased cloud copies cannot be recovered through the service. Signing up again creates a new account and does not restore deleted backups or a deleted account's subscription access.
Availability and responsibility
Maintenance, networks and provider outages can interrupt service. Keep your own copies of important memories. We do not guarantee uninterrupted availability or that a backup will succeed merely because automatic backup is enabled. Nothing here excludes rights or liability that cannot lawfully be excluded. Any proposed financial liability limit requires separate legal approval and has not been inserted into this draft.
Law, concerns and changes
These terms are intended to be governed by Nigerian law, subject to mandatory rights that apply to you. Contact support first to seek a practical resolution; this does not restrict access to a competent court or regulator. No exclusive state venue has been selected. Material revisions will be notified where required and dated when approved.
